Perkembangan dunia teknologi informasi dewasa ini telah membawa manusia kepada era globalisasi yang memberikan kebebasan kepada setiap orang di dunia untuk saling bersosialisasi dengan siapapun dan dimanapun mereka berada. Internet merupakan media utama yang dapat digunakan, karena melalui media internet seseorang dapat terhubung dengan teman atau bahkan dengan orang asing yang sama sekali tidak dikenal dan berdomisili di luar negeri.


Kemajuan teknologi informasi dan komunikasi telah melahirkan berbagai dampak, baik dampak positif maupun dampak negatif, karena di satu sisi memberikan kontribusi bagi peningkatan kesejahteraan, kemajuan dan peradaban manusia, namun di sisi lain menjadi sarana efektif perbuatan melanggar hukum. Teknologi informasi dan komunikasi juga telah mengubah perilaku dan pola hidup masyarakat secara global, dan menyebabkan dunia menjadi tanpa batas (borderless), serta menimbulkan perubahan di berbagai bidang kehidupan. Perkembangan teknologi informasi telah melahirkan beragam jasa di bidang teknologi informasi dan komunikasi dengan berbagai fasilitasnya, dalam hal ini internet merupakan bagian dari kemajuan teknologi informasi tersebut, yang memberi kemudahan dalam berinteraksi tanpa harus berhadapan secara langsung satu sama lain.

The present Undang-Undang Number 11/2008 about Electronic Information and Technology has not been able to accommodate the raising problem such as criminal act in virtual world. Some of the problems are found in the regulation for criminal act of spreading computer virus through e-mail (cyber spamming) under Undang-Undang ITE and legal action charged to the aforementioned actor.


To fulfill the above aim, the writer conducted an analytical descriptive study with juridical normative approach. The data were analyzed in qualitatively juridical in which one into another regulation should not contradict and should concern with the hierarchy of regulation and law enforcement.


The spreading of computer virus through e-mail is one of forbidden acts as stated in article 30 paragraph (2) Undang-Undang ITE considering that e-mail becomes an electronic information and/or document that may become the proof as stated in article 5 paragraph (1) and (2) Undang-Undang ITE. Besides, E-mail may also become the written Proof mail as proven direction as stated in article 184 KUHAP. Therefore, the spreading of computer virus through e-mail can be charged wit article 46 paragraph (2) juncto Article 30 paragraph (2) Undang-Undang ITE. Legal action charged to the actor of spreading computer virus through e-mail is in the form of lawsuit under the effective jurisdiction and law considering that the actor is domiciled in the different country with the victim of this crime and the locus delicti is hardly determined as it occurred in the virtual world. However the effective jurisdiction and law may be determined according to the effective principles such as Subjective Territorial that is the effective law according to the place of the criminal act and charge in other countries. The other principles are Objective Territorial that is the effective law concerning the main impact and negative impact for the related countries, nationality is the effective law based on the citizenship of the actor, Passive Nationality is the effective law based on the citizenship of the victim, Protective is the effective law based on the effort of the country to protect the citizen from crime conducted in outside of the area and Universality is the effective law for serious inter nation crimes such as piracy and terrorism (crime against humanity). If the effective law is the Indonesian criminal codes, the actor of Spreading computer virus through e-mail can be charged under article 46 paragraph (2) jo. Article 30 paragraph (2) Undang-Undang ITE.
